Terms and Conditions

Thank you for supporting the Mustang Sally raffle, conducted by International Medical Assistance Corporation herein referred to as IMAC. Your purchase of one or more Mustang Sally raffle ticket(s) signifies your agreement to the following Terms & Conditions. In the event of any dispute, a reasonable interpretation or determination by IMAC regarding the application of these Terms & Conditions is final and binding. The Mustang Sally raffle is void where prohibited by law.


To be eligible to purchase a ticket, you must be at least 18 years old and a resident of the United States. The following persons, their employees and immediate family members, are not eligible to purchase a ticket: Officers, directors, and employees of IMAC, Damascus Road Restoration and Collision, Legion Ministries, Fresh Start Ministries, Women of Grace and Truth and Nails Technical Center. “Immediate family members” includes the spouse, parents, grandparents, great-grandparents, brothers, sisters, children, grandchildren, and great­grandchildren of the employee and his/her spouse, directors or officers. This definition also includes individuals for whom an employee is the current legal guardian or individuals who are not legally related to but who reside with an employee, including “step” and adoptive relationships.

The determinations of IMAC are final and binding with respect to any matter arising out of the interpretation or application of these terms and conditions.

No ticket may be purchased by any member of the Tennessee General Assembly or by any employee of the Secretary of State of Tennessee.  (Tenn. Code Ann. § 3­17­109(a),(b))

A ticket purchased by an ineligible person is void, and cannot be a winning ticket. No refunds will be made to ineligible purchasers.

A ticket issued in exchange for a check returned for “insufficient funds,” or for a credit card charge that was “declined,” or reported as “invalid” or “stolen” is void, and cannot be a winning ticket.


A ticket represents a chance to win the opportunity to accept an offer of the stated prize. Each ticket will be entered separately in the drawing. Each ticket has a separate and equal chance to win Mustang Sally. All sales of tickets are final, and no refunds will be paid. Tickets, receipts, and any winner’s rights are not transferable. The IRS has ruled that a payment for a raffle ticket is a tax-deductible charitable contribution only to the extent the amount of the payment exceeds the price of the ticket. Due to postal regulations, raffle tickets cannot be mailed to you.  We will email you a receipt for your order with the ticket number(s) or send it by regular mail if you do not have an email account. When an order is placed, we will complete the ticket by filling in the name, address, email address and phone number, and we will drop the ticket stub in the barrel. After the drawing, the winner will be contacted based on the name and information on the ticket. 

The Drawing

The raffle drawing will be held at the Gateway Church in Shelbyville Tennessee on August 31, 2016. All tickets must be received by 6:30 pm (CDT) August 30, 2016 to be eligible for the drawing. Ticket purchasers need not be present to win.

The Presentation

Mustang Sally will be presented to the winner at the Cruise In Classic Car Rally at Gateway Church in Shelbyville, Tennessee on October 22, 2016.


After the drawing, the winner will be contacted based on the name and information on the ticket. To pick up the vehicle two forms of identification, one of which must be a photo ID, will be required to prove that this person is the person on the winning ticket. Winner notification will be made by telephone or mail. A ticket receipt is not necessary to claim prize in this drawing.  All tickets are numbered. Successive alternate backup winners will be drawn and held by IMAC (but not announced) in case the first winner does not contact IMAC within 30 days, is deceased, we can’t contact winner due to incorrect contact information supplied to us or is otherwise ineligible. If the winner fails to accept Mustang Sally, the prize is forfeited and no substitute or alternative prize will be provided. The forfeited prize will be awarded to the next alternate backup winner. Participant/winner must be at least 18 years old. Winner may be required to sign an affidavit of eligibility. Acceptance of Mustang Sally constitutes permission for IMAC to use the winner’s name, picture, video image, and relevant quotes to promote future IMAC raffles and to sign a publicity release without any further compensation. In the event the Mustang Sally is lost, damaged, destroyed, or otherwise not available, IMAC has the right to substitute another car of similar value for the raffle. Ticket refunds will not be issued if this should occur. Winner is solely responsible for all taxes, title, registration, transfer fees, license duties, insurance and all expenses in claiming, registering and using Mustang Sally. These may include sales taxes and personal property taxes. IMAC has no liability with regard to taxes and fees for the vehicle. Vehicle will not be modified by IMAC to meet specific local, state or country requirements. Winner agrees to accept the vehicle as restored for U.S. licensing and registration requirements. Winner will be responsible for any modifications required for export to a country outside of the U.S.


The value of each prize is includible in the winner’s gross income, and is subject to reporting by IMAC to the Internal Revenue Service. Each winner is solely responsible for payment of all federal, state, and/or local income, sales, or use taxes due on account of his or her acceptance of the prize. The winner of Mustang Sally agrees that the value of the vehicle reported by IMAC for income tax and other purposes will be based on a written appraisal obtained by IMAC. By law, the winner agrees to pay 25% federal income tax on the fair market value of the prize to IMAC prior to release of Mustang Sally. IMAC will submit the taxes collected to the IRS. After the end of the year, IMAC will file a form W-2G with the IRS to report the value of the prize won and the taxes paid in by the winner. All nonresident aliens are required by IRS regulations to pay 30% US income tax on the value of the prize unless the winner is a resident of specific countries exempted by treaty. This amount must be paid to IMAC prior to release of the prize. After the end of the year, IMAC will file a Form 1042 and 1042-S to report the value of the prize won and the taxes paid in by the winner. The winner will receive a copy. Winners should consult a tax professional.

Winner must provide their social security number and other personal information to IMAC for tax purposes. The winner is responsible for payment of applicable taxes, titling, and licensing fees prior to receiving the vehicle.

No Warranty

Winner accepts the prize “as is,” and without recourse to IMAC with respect to any defect, injury, damage, or other problem that may arise or become apparent with respect to the prize. IMAC disclaims any and all warranties with respect to each prize, including but not limited to any warranty of fitness for a particular purpose.

Limitation of liability

Because IMAC has no right to control, nor exercises any control, over the personnel, equipment, or operations of any rebuilder, seller, or manufacturer of the prize, or any part of the prize, IMAC assumes no responsibility for any financial loss, personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity that a winner may experience by reason of (1) performance or nonperformance by any supplier; (2) wrongful, careless, negligent, or unauthorized acts or omissions by any supplier or its employees, or by any other party not under the control of IMAC; (3) acts of God and acts or omissions of third parties; (4) mechanical failures; or any other event or condition beyond IMAC’s control. Each winner hereby releases and holds IMAC harmless with respect to any claim based on any such occurrence. IMAC reserves the right to cancel this contest at any time, in which event its liability is limited to refund of ticket prices to participants.

IMAC shall in no event be liable for special or consequential damages arising from the use or ownership of Mustang Sally.
